In the Terms and Conditions set forth below, the terms “you” and “your” refer to ANY person or ENTITY VISITING OUR SITE, OR USING OUR SERVICES, sending an item or items (hereinafter referred to as “Merchandise”) to Gold-Cash.com.com for sale and purchase (hereinafter referred to as “Transaction”). “We”, “our”, and “us” refer to Generation Jewelers LLC and Gold-Cash.com and its successors and assigns.

Requirements: You agree that you are at least 18 years of age and are the actual owner (not acting on behalf of or as representative of another) of any and all merchandise sold or attempted to be sold to Gold-Cash.com.
Generations Jewelers LLC or Gold-Cash.com may ask for documentation or other proof of compliance with the above requirements. FURTHERMORE, you represent that all merchandise that you send us is free of any and all claims, liens, or any encumbrances, that might adversely affect the value of your Merchandise or your ability to sell it to us.
Describing your Merchandise: You agree to accurately list and describe the Merchandise that you send to us on an inventory card, which you can print from our website or receive from us by mail.

GUARANTEE AGAINST LOSS

After completing the online form, we will either mail you all the shipping and packaging materials at our expense or you may print the FedEx® shipping label, packing slip, and instructions from our website. If you choose this method of shipping, follow our instructions, and use the FedEx® shipping label provided by us, we will pay your inbound shipping costs, and guarantee your package against loss (through FedEx) or damage of up to $500.00. If you believe that you need additional coverage, then it is your responsibility to obtain such additional coverage at your expense, and we will reimburse you for your costs up to $20.00. We Suggest that you go to your local USPS Office and send your package Registered, return receipt, and Insured for the Dollar amount you estimate the package to be worth. Include the receipt detailing the shipping costs in your package, and we will reimburse you for your expense up to $20.00.

Cash-Gold.com reserves the right to reject the delivery of any package sent to us that appears to be opened, damaged, or tampered with in any way. The Post Office, or Shipping Company, will return the package to you, and Gold-Cash.com will have no liability to any customer for the attempted delivery or return of any such packages.

In the event that your package is lost we will require that you: Provide proof of shipping receipt; provide receipt of proof that goods are lost; and file a claim within 30 days of loss. In the event your package is damaged we will require that you: Provide proof of shipping receipt; provide receipt of proof that goods are damaged; demonstrate that the package was not damaged prior to shipping; file a claim within 30 days of loss. GOLD-CASH.COM WILL NOT BE RESPONSIBLE FOR ANY PACKAGES LOST OR STOLEN FOR AN AMOUNT THAT EXCEEDS $500.00

Limitation of Liability

Limitation of liability shall be binding on the customer/seller and any third party, including but not limited to, customer's/seller's, successors, insurance carriers and any other individual or entity asserting any right or claim relating to this transaction.
In no event shall Gold-Cash.com be liable to any third party, including any insurance carrier. Gold-Cash.com shall not be liable for any subrogation claim brought by customer's/seller's insurance carrier and, by submitting an item to gold-Cash.com, customer/seller expressly and specifically waives any such subrogation claim on his or her behalf as well as on the behalf of his or her insurance carrier.
Gold-Cash.com’s liability is and shall be expressly and specifically limited to the LEAST of the following sums:

1. The liquidation value placed on the item by gold-cash.com in its sole discretion.
2. The sum of $100.00.
The customer/seller expressly acknowledges and agrees that Gold-Cash.com’s liquidated value shall be conclusive and binding and further, that in no event shall Gold-Cash.com’s Liability exceed $100.00.
Gold-Cash.com shall not be liable to anyone for any damages, including but not limited to, incidental, consequential, punitive, loss of profit or opportunity, other than as set forth herein above.

By submitting the item, customer/seller explicitly accepts this limitation of liability.

Settlement: Upon processing your Merchandise, we will notify you by email or telephone of our settlement payment offer for your Merchandise and provide options for payment methods (“Settlement Notice”). You must accept or decline your Settlement payment offer and select a method of payment within 72 hours after we send our “Settlement Notice” to you by replying to our email. If you have not replied to our email to accept or decline your Settlement Offer within the time frame set forth above, and have not contacted us to express your intent to the contrary, then you will be deemed to have accepted the Settlement, and we will issue payment of your Settlement via our Company Check sent through USPS.


Method of Payment: The following four Methods of Payment are available: 1) Company check sent via the United States Postal Service. This is our default Settlement payment method; If you fail to select a payment method at the time you accept our settlement, or fail to accept our payment offer within 72 hours the offer is issued, then you will receive a company check via the United States Postal Service, 2) Company check sent via FedEx Overnight shipping with the fee of $23 deducted from the payment of your Settlement. FedEx Overnight delivers weekdays only and is not available for delivery on Saturday or Sunday, 3) Wire transfer into your bank or brokerage account in accordance with the instructions you provide to us with the fee of $12.50 deducted from the payment of your Settlement and will be waived if your Settlement is over $400, 4) Transfer money to your PayPal™ account in accordance with the instructions you provide to us (PayPal™ may charge additional fees for this service). It is your responsibility to know the terms and conditions of the method of payment you select as set forth herein and as stated on our website. By selecting the payment method of your Settlement by any method other than our default method, you acknowledge and agree that the sale is final, and we own the merchandise, and you will have no right to decline the Settlement or demand that the Merchandise be returned to you, and that the Merchandise will be destroyed in accordance with our procedures, which include melting and refining. You further acknowledge and agree that if you had selected payment by company check shipped via USPS instead of any other method of payment, you would have had the ability to decline our offer within a 10 day period from which the check was issued. Settlement Paid by Company Check Shipped via USPS: If you fail to notify us of your acceptance of our payment settlement offer, or choose to be paid by a Company check via USPS, you will have 10 business days to change your mind, and we will return your merchandise via a carrier of our choice, and will insure it for our settlement amount. If you change your mind and decide not to accept our settlement offer, you must: (a) notify us via email at returns@Gold-Cash.com - or telephone at (866) 988-9288 that you now choose to decline the Settlement and will be returning the un-cashed check to us on a timely basis, and (b) we must receive your returned un-cashed check within 10 business days from the date the check was issued. You are responsible for sending the un-cashed check to G-C.com, 150 Aerial Way, Syosset New York 11791. If you satisfy the requirements set forth in this paragraph, then we will return your Merchandise as specified herein. Failure to satisfy the requirements set forth in this paragraph will cause you to forfeit your right to decline the Settlement, and the Transaction will be final, we will own the Merchandise, and the Merchandise will be destroyed in accordance with our procedures, which include melting and refining. If you notify us by email or telephone that you decline the Settlement Offer before payment is processed and before a company check is sent to you, then we will return your Merchandise to you at the address indicated in our records within 2 business days via FedEx Express Saver® shipping at no cost to you, and insuring your Merchandise for full value of the Settlement.
Returned Merchandise Outbound Insurance, Costs, Insurance: In the event that your Merchandise is returned to you in accordance with these Terms and Conditions, we will ship your Merchandise to you at your address as it appears in our records via the FedEx® shipping method of our choosing at our expense, and will provide coverage through the FedEx® Declared Value Exemption program for the Merchandise for the full value of the rejected Settlement. If a package containing your Merchandise is lost in transit while being returned to you in accordance with these Terms and Conditions, we will file a claim with FedEx® and pay you the full value of the rejected settlement. Please note that items not containing precious metals WILL NOT BE RETURNED by Gold-Cash.com except that you may request these items be returned to you at your expense. In such case, Gold-Cash.com will charge a fifteen dollar ($15) fee to cover return postage and processing in order to return items not containing precious metals to you. Your items will be sent COD.

110% Price Guarantee: There are two parts to our 110% Price Guarantee. First, you must receive (from a Nationally advertised and licensed Gold Buying Company) an itemized written offer for your Merchandise within 10 days from sending in the same merchandise to us. Attach a copy of their offer, and if their original written offer is more than Gold-Cash.com’s, we will match their offer (based on that day’s Gold price) plus an additional 10% bonus.
Second: Gold-Cash.com holds onto your merchandise for 10 days after we send out your check. If for any reason you change your mind, return the settlement check, call or email us, and we will gladly return your merchandise at no charge to you, using FedEx Saver shipping at no cost to you, and insuring your Merchandise at the full settlement value. If you Cash your check, or use any of our direct deposit or PayPalâ„¢ settlement options, the sale is considered final, your Merchandise will be melted and is then impossible to recover.

Electronic Signature: FOR PURPOSES OF THE TRANSACTION, YOU HEREBY AGREE TO THE USE OF ELECTRONIC SIGNATURES, RECEIPT OF NOTICES BY E-MAIL, USE OF ELECTRONIC CONTRACTS, AND TO ACCEPT THESE TERMS AND CONDITIONS BY ELECTRONIC MEANS. YOU AGREE THAT CLICKING THE SUBMIT BOX AT THE END OF THE SELLYOURGOLD.COM GET STARTED FORM CONSTITUTES YOUR ELECTRONIC SIGNATURE. 
Limitation of Liability: IN ALL EVENTS THROUGHOUT THESE TERMS AND CONDITIONS, YOU AGREE THAT THE LEGAL LIMIT OF OUR LIABILITY TO YOU FOR ANY CLAIMS OR ACTIONS FOR LOST, DAMAGED, OR DESTROYED MERCHANDISE SHALL NOT EXCEED THE LESSER OF OUR SETTLEMENT TO YOU OR $1,000 PER TRANSACTION. YOU AGREE THAT WE WILL NOT BE LIABLE FOR (a) INCIDENTAL, SPECIAL, INDIRECT, CONSEQUENTIAL,OR PUNATIVE DAMAGES, OR LOSS OF PROFIT OR OPPORTUNITY; (b) CLAIMS, DEMANDS, OR ACTIONS FOR ANY SUBROGATION CLAIM BROUGHT BY YOUR INSURANCE CARRIER, AND YOU EXPRESSLY AND SPECIFICALLY WAIVE ANY SUBROGATION CLAIM ON YOUR BEHALF AS WELL AS ON BEHALF OF YOUR INSURANCE CARRIER. 

Miscellaneous: You agree that you provided to us the email address, physical address, and telephone numbers that are in our records, and it is your responsibility to provide us with any current or updated contact information. You further agree that: (a) any email message that we send to you is deemed to have been effectively received by you and constitutes due notice to you by email; and (b) any phone message we leave with you, anyone answering your phone, or on your answering machine or service is effectively received by you and constitutes due notice to you by telephone. In the event of any strike, disruption of service, or any other problems that we might encounter with FedEx, we reserve the right in our discretion to replace FedEx with another shipping carrier. Gold-Cash.com is licensed to do business in the State of New York, and is governed by the laws of the State of New York. YOU EXPRESSLY AGREE THAT ANY CLAIMS, LAWSUITS, ACTIONS, DISPUTES, CONTROVERSIES OR OTHER MATTERS AGAINST Gold-Cash.com or Generation Jewelers LLC ARISING OUT OF, OR RELATING TO, THIS AGREEMENT OR BREACH THEREOF SHALL BE SETTLED SOLELY AND EXCLUSIVELY VIA BINDING ARBITRATION PURSUANT TO THE RULES OF THE AMERICAN ARBITRATION ASSOCIATION. SAID ARBITRATION SHALL TAKE PLACE IN the Town of Oyster Bay, New York. You expressly agree that any such Court and/or Arbitrator has personal jurisdiction over you. You waive all defenses of lack of personal jurisdiction and forum non-convenience. You agree that each party shall bear its own attorneys fees and expenses. You agree to abide by all decisions and awards rendered in such Arbitration proceedings, and that such decisions and awards rendered by the Arbitrator shall be final and conclusive. You agree that the Arbitrator shall not have the right to award punitive damages or speculative damages. The Arbitrator shall be required to follow applicable law of the State of New York
